Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service / website

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service across our websites.

Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

You agree not to disclose your password to any third party when accessing your account through our website which will then take you through our company CRM system. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trade mark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene. You expressly agree that we cannot be held liable for any loss or damage arising out of any misrepresentations you make in this regard.

Online Bookings

Once you have completed our online booking process, our office will contact you as soon as possible in order to confirm all details provided and your availability. No booking shall be binding on VCDE until we issue you with a confirmation email.

A contract is formed between you and VCDE when we issue you with a confirmation email for your booking.
The decision to accept your appointment shall be at our sole discretion and a booking shall not be made until you have received an email from us confirming the booking.

We have the right to refuse any bookings. We reserve the right to verify or require proof of all information given in the online booking process. Any fraudulent or wrongful information given in order to obtain a booking could result in the cancellation of your booking.

We only accept online/phone bookings by people over the age of 18.
Subject to the booking being confirmed and subject to you paying the Engineer Booking Deposit, we will endeavour to give you our best time estimated for doing the work and we will do our best to keep to this, if at any time we are unable to meet our time frame due to any unforeseen circumstances we will let you know as soon as possible and arrange a new time.

We will use our reasonable efforts to ensure that each appointment is kept, but times shall be estimates only and shall not be of the essence for the provision of our services.

Changes to payment and refund policy

We reserve the right to change this payment, refunds policy terms and conditions at any time. Any such changes will take effect when posted on the website.

Refunds

We will not refund the Engineer Booking Deposit, if an engineer attends your home to carry out the work and is unable to gain access or has been denied access. If you would like to cancel your appointment, you must give us a minimum of 24 hours’ notice prior to the appointment, failure to notify us of the cancellation, no refund will be issued. This does not affect your Statutory rights under The Consumer Rights Act 2015

All refunds will be credited to the credit/debit card or account to which your online booking was charged. Please allow a reasonable time for the refund to be charged back to your card or account.

Working in dangerous conditions

Before our engineers commence work on your premise a risk assessment will be undertaken to highlight the risk associated with job at hand. If our engineers believe that their health and safety is at risk, for example: verbal or physical abuse, harassment, hazardous chemicals, pest infestations etc The responsible person will be informed by VCDE Ltd’s Customer Relation Manager of the engineer’s decision not to return to finish the work until the risk is gone.

If asbestos is discovered in your home, the responsible person will be informed for he/she to arrange for a specialized asbestos contractor to assist with the removal before any further work on the appliance can be undertaken or in and around the vicinity. (This is determined on the job). A Certificate of Reoccupation will be issued by the competent contractor after the 4th stage of removal to advise asbestos clearance – a copy of the certificate will need to be sent to our office for our records and to inform engineer for future work.

Parking
Before arranging for an appointment, we will ask if parking is available, close or on your property. Where parking is not available, we might not be able to carry out the work requested by you.

Intellectual Property.

The Service and its original content, features and functionality are and will remain the exclusive property of Vassell’s Commercial & Domestic Engineers Ltd and its licensors. The Service is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Vassell’s Commercial & Domestic Engineers Ltd.

Our Service may contain links to third-party web sites or services that are not owned or controlled by Vassell’s Commercial & Domestic Engineers Ltd.

Termination

All provisions of the Terms which by their nature should survive termination, shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

You agree to defend, indemnify and hold harmless Vassell’s Commercial & Domestic Engineers Ltd and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.

In no event shall Vassell’s Commercial & Domestic Engineers Ltd, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from  your access to or use of or inability to access or use the Service; any conduct or content of any third party on the Service;  any content obtained from the Service; and unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 14 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Fees

Vassell’s Commercial And Domestic Engineers  Ltd retain the rights to change cost for out or respect of a products and services that we provide to all our customers,

All services that is provided by Vassell’s Commercial Domestic Engineers Ltd  is subject to vat.
